Terms of Use

These Terms of Use ("Terms") govern your use of the Peak State Golf website at peakstategolf.pro (the "Website") and the Peak State Golf mobile application (the "App"), together the "Services," operated by Wade Pearse / Peak State Golf ("Peak State Golf," "we," "us," or "our").

By accessing the Website, downloading the App, or purchasing any product, you agree to these Terms. If you do not agree, do not use the Services.

Peak State Golf provides golf mental performance coaching content — articles, audio, video, and a structured self-assessment and training system built around 18 mental skills (the "Mental Game Wheel"). The App also includes a self-rated performance scorecard ("Mental Game Scorecard") and a "Playing Styles" personalization feature.

Peak State Golf is educational and self-coaching content. It is not:

• A substitute for professional instruction from a PGA or LPGA teaching professional
• Medical, psychological, or psychiatric treatment or advice
• A guarantee of any specific performance outcome, handicap change, or competitive result

Individual results vary. References to Wade Pearse's own handicap improvement or any student's results describe specific, individual outcomes and are not a promise of similar results for any other user.

You must be at least 18 years old to create an account or make a purchase. If you are using the Services on behalf of a minor, you confirm you are their parent or legal guardian and accept these Terms on their behalf.

Creating an account requires an email address and name, as described in our Privacy Policy. You are responsible for keeping your login credentials secure and for all activity under your account. Tell us immediately if you suspect unauthorized access.

You can permanently delete your account at any time from Profile → Delete Account inside the App (typed DELETE confirmation required). This is permanent and cascades to your profile, progress, challenge log, and linked devices. Deleting your account does not cancel any active App Store or Google Play subscription billing. Cancel your subscription first, then delete your account, to avoid continued charges.

Pro and Elite are each available as an auto-renewing monthly or annual subscription (psg_pro_annual — $99/year, psg_elite_annual — $199/year, plus the corresponding monthly plans), purchased and billed through the Apple App Store or Google Play Store. By subscribing you acknowledge:

• Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
• Subscriptions automatically renew at the end of each billing period (monthly or annual, matching the plan you selected) unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price you agreed to at signup.
• You can manage or cancel your subscription any time in your Apple ID or Google Play account settings — Peak State Golf cannot process App Store or Play Store cancellations or refunds directly.
• Refunds for subscription purchases are handled by Apple or Google under their own refund policies, not by Peak State Golf.
• Elite content is delivered one spoke at a time, gated by a per-spoke application assessment. Canceling a subscription stops future access; it does not accelerate or unlock spokes ahead of completing the current one's assessment.

Lifetime Elite is a one-time purchase available exclusively at peakstategolf.pro, processed by Stripe. It is not available for purchase inside the App, and is never referenced, sold, or promoted within the App, in compliance with Apple App Store policy.

Upon successful payment, Stripe confirms the purchase to our server, which grants permanent Elite access to your linked account (is_lifetime: true), with all 18 spokes immediately unlocked — no application-assessment gating.

Refund policy: Refunds may be requested within 30 days of purchase by contacting .

Peak State Golf does not store your card details. Stripe processes and stores all payment card data under its own security standards (PCI-DSS compliant).

We may change subscription or one-time purchase pricing at any time. Price changes will not affect a Lifetime Elite purchase already completed, and will not retroactively change the price of an active subscription term already paid for.

You agree not to:

• Use the Services for any unlawful purpose
• Attempt to reverse-engineer, scrape, or extract the Mental Game Wheel framework, Scorecard logic, or app content for resale or redistribution
• Share a single paid account across multiple users
• Attempt to circumvent content drip-gating, tier restrictions, or entitlement checks
• Upload or transmit harmful code to the Website or App

We may suspend or terminate access for violation of these Terms.

All content, frameworks, trademarks, and materials on the Website and in the App — including the "Mental Game Wheel," "Mental Game Scorecard," "Peak State Golf" name and logo, the 18-skill framework, Playing Styles system, and all articles, audio, and video — are the property of Wade Pearse / Peak State Golf and protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our written permission.

You retain ownership of anything you personally enter into the Services (e.g., your challenge log entries, self-ratings). You grant us a license to store and process that content solely to operate the Services for you, as described in our Privacy Policy.

The Services are provided "as is" without warranties of any kind, express or implied. We do not guarantee the Services will be uninterrupted, error-free, or secure.

Peak State Golf is a mental performance coaching product, not a substitute for medical or mental health care. If you are experiencing a mental health crisis, contact a licensed professional or emergency services — not Peak State Golf.

To the maximum extent permitted by law, Peak State Golf is not liable for any indirect, incidental, or consequential damages arising from your use of the Services, including any golf performance outcome, competitive result, or handicap change. Our total liability for any claim will not exceed the amount you paid to Peak State Golf in the 12 months preceding the claim.

We may update these Terms from time to time. Material changes will be reflected by an updated "Last Updated" date, and, where required, additional notice inside the App. Continued use of the Services after changes take effect means you accept the updated Terms.

These Terms are governed by the laws of British Columbia, Canada, without regard to conflict of law principles.
